Demico (Pty) Ltd ("Demico", "we", "us", "our") operates the MilaNet application, website(s), and services (collectively, the "Platform").
By using the Platform, you agree to these Terms of Use ("Terms").
1. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the Platform.
2. Account Registration and Security
You must provide accurate and complete information during registration.
You are responsible for maintaining the confidentiality of your account credentials.
You must promptly notify us if you become aware of any unauthorized access to your account.
3. License to Use the Platform
MilaNet grants you a non-exclusive, non-transferable, revocable license to use the software and services provided on the Platform for your personal, lawful use.
You may not copy, modify, distribute, sell, lease, or create derivative works from the Platform except with explicit written consent from Demico.
4. Networks, Organizations, and User Content
You may create and administer networks and organizations, and you may post or share content such as messages, notices, deals, classifieds, events, documents, and images.
You are responsible for the content you submit and for ensuring that your content complies with applicable laws and these Terms.
5. Content License
By posting, uploading, or otherwise submitting content to the Platform, you grant Demico a worldwide, non-exclusive, transferable, sub-licensable, royalty-free license to host, store, reproduce, distribute, display, perform, and otherwise use your content as required to:
Operate and provide the Platform to you and other users
Process content for moderation, security, and compliance purposes
Provide search and indexing functionality (including via third-party search providers)
This license continues only for as long as your content is available on the Platform and as needed to comply with legal and operational requirements.
6. Acceptable Use and Prohibited Conduct
You must not use the Platform to:
Violate any applicable law or regulation
Infringe intellectual property rights or misuse trademarks/branding
Transmit or promote illegal, harmful, abusive, or fraudulent content
Harass, threaten, or discriminate against any person or group
Post or distribute adult or pornographic content or sexually explicit material
Send spam, scams, or unsolicited promotional messages
Attempt to interfere with, disrupt, or gain unauthorized access to the Platform, accounts, or underlying systems
We may investigate and take action against violations, including removing content or suspending accounts.
7. Messaging (Including Encryption)
The Platform includes chat messaging.
Chat message text is encrypted on the device before being stored.
To deliver useful push notifications, our server may decrypt relevant content to generate notification preview text (for example, sender name and message preview).
You are responsible for what you send through messaging.
8. Monitoring, Moderation, and Removal
We reserve the right (but not the obligation) to monitor, review, limit, or remove content that we believe violates these Terms or applicable law.
We may also suspend or terminate accounts that repeatedly violate our policies.
9. Disclaimers
The Platform is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, Demico disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law:
Demico will not be liable for indirect, incidental, special, consequential, or punitive damages
Demico is not responsible for the actions, conduct, or content of users, network administrators, or organizations
Use of the Platform is at your own risk.
11. Dispute Resolution
Any dispute arising from or relating to these Terms or your use of the Platform will be resolved through arbitration conducted in South Africa, in accordance with applicable arbitration law.
You and Demico agree that arbitration shall be the exclusive forum for resolving such disputes.
12. Termination
We may terminate or suspend your access to the Platform (including subscription-related access, where applicable) if you violate these Terms or misuse the Platform.
We may, where feasible, provide notice before suspension or termination.
13. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we will make reasonable efforts to notify users through the Platform or other appropriate means.
14. Governing Law
These Terms are governed by the laws of South Africa.
